According to nutroot blog FireDogLake, Pelosi has made a deal in which his abortion language would be substituted for Senate language:
House Speaker Nancy Pelosi has made a deal with Rep. Bart Stupak in order to secure his vote and that of other anti-choice Democrats for the health care bill, which is scheduled to be voted on this Sunday.
How would it work?
Pelosi has agreed to let Stupak have a vote on his amendment either before or after the House votes to pass the Senate bill. It instructs the Senate to substitute the language in his amendment for the Senate language on abortion.
I have no idea how this will play with the pro-abortion crowd, or how it works constitutionally. But, if it flies, that’s the end. The bad guys win.
UPDATE:
This deal, assuming there is a deal and that the whole thing isn’t just a gaseous effusion from the fever swamp of FDL, may well break up on the rocks of the pro-abortion caucus. They compromised last year and vowed, at that time, not to do it again:
[Last year’s] vote prompted an angry backlash from members of the Pro-Choice Caucus, who vowed to kill any future healthcare bill containing the Stupak language, which they say goes beyond current law and places more restrictions on abortion than already exist.
Stupak has scheduled a press conference for 11am this morning, at which time we will hear the truth latest talking point. But we have to remember that Stupak, in the end, is a Democrat.

I do love the Dems: we’ll just re-write the rules of how the game is played, at will–tough luck, America!
(Which is to say: I can’t imagine the Supreme Court just letting this whole thing slide as no harm, no foul.)
