FLORIDA JUDGE WILL LET ANTI-OBAMACARE LAWSUIT GO FORWARD

This is the case, brought in Pensacola by twenty state Attorneys General, challenging the power of Congress to pass a law requiring everyone in the country to buy health insurance. Judge Vinson will apparently shoot down part of the lawsuit, but allow the rest to proceed:

A federal judge said Tuesday he will likely dismiss only parts of a lawsuit by 20 states challenging the Obama administration’s health care overhaul as unconstitutional, though he didn’t specifically say what portions.

The Obama DOJ had, of course, asked the judge to dismiss the case. But the judge wasn’t convinced by the government’s bizarre reasoning:

The judge questioned whether the administration was correct in arguing that all Americans are active participants in the health care system regardless of whether they choose to have health insurance.

The DOJ says you’re engaging in interstate commerce by NOT buying something. It’s preposterous!

UPDATE:

Judge Vinson is a man of his word. He has now ruled on the case and, as expected, he dealt the Obama DOJ a heavy blow.
