OBAMACARE & CRIMINAL INTENT

My latest article for the American Spectator is about an obscure section of ObamaCare that undermines a core principle of our justice system—-that a person cannot be convicted of a felony unless it has been proven that he acted with “criminal intent.”

Section 6402 revises existing law so that the government can ignore the criminal intent principle in violations of the Anti-Kickback Statute (AKB) … The authors of PPACA used the health care bill to revise the statute such that ‘a person need not have actual knowledge of [AKB] or specific intent to commit a violation.’

In other words, ObamaCare has made it easy and convenient for federal prosecutors to throw doctors and hospital executives in jail for unintentially violating laws they have never heard of.  This is easily the scariest provision of the law. Read the rest of the story here.
