While we voters celebrated our midterm victory over the arrogant Democrats in Congress and the White House, they were busy preparing a special Christmas present for us: newly wrapped death panels:

When a proposal to encourage end-of-life planning touched off a political storm over ‘death panels,’ Democrats dropped it from legislation to overhaul the health care system. But the Obama administration will achieve the same goal by regulation, starting Jan. 1.

In other words, the Dems don’t really give a rat’s ass about voter opinion on this. If the democratic process won’t work, then they will simply impose their will via bureaucratic fiat:

Under the new policy, outlined in a Medicare regulation, the government will pay doctors who advise patients on options for end-of-life care, which may include advance directives to forgo aggressive life-sustaining treatment.

Did you get that? The federal government will PAY physicians to offer DEATH rather than all that expensive and bothersome medical care. And here’s the most Orwellian feature:

The new rule allows annual discussions as part of the wellness visit … It will give people more control over the care they receive.

And, if you doubt this is a “to Hell with the voters” moment, I offer the following from the minions of Rep. Earl Blumenauer of Oregon, who wrote the original end-of-life proposal in the House:

After learning of the administration’s decision, Mr. Blumenauer’s office celebrated “a quiet victory,? but urged supporters not to crow about it.

And by telling supporters “not to crow about it,” they mean “try to sneak it past the American people.” In fact, his office sent out an e-mail telling their accomplices to keep it secret as long as possible:

We would ask that you not broadcast this accomplishment out to any of your lists … The longer this goes unnoticed, the better our chances of keeping it.

These people are absolutely incorrigible. They are determined to ignore the will of the people. The only cure for this disease to eradicate the Democrats, root and branch (all three branches).


The two features of this bureaucratic skulduggery that have caused the most comment are the regulatory end run around Congress and the two-month failure to report a tactic that was launched in early November. Here’s Ed Morrissey:

Congress made it clear that it didn’t want this incentive as part of the new law. However, thanks to the miles and miles of ambiguity in the final version of ObamaCare, with its repetitive the Secretary shall determine language, Congress has more or less passed a blank check for regulatory growth to Obama and Sebelius.

And here is Tom Maguire:

The decision was made in ‘early November’ and goes into effect on Jan 1? And we are hearing about it the day after Christmas? Very slick. How much more health care reform by way of stealth regulation should we expect from the most transparent Administration in history?

And here is William Jacobson:

The fact that such a controversial change was kept quiet for so long, and that the Obama administration took steps to keep it quiet, is most troublesome of all … Defunding is the only option at this point, because the regulators cannot be trusted.


 For a preview of the”progressive” party line:

Advanced directives aren’t controversial. They aren’t new … There are provisions in all fifty states for anyone to draft an advanced directive, with or without a lawyer.

This is, of course, a straw man. Here’s the rub:

All this rule change does is allow Medicare to pay doctors for a consult on the medical issues surrounding end of life care.

Oh, is that all? The federal government has already trained physicians to be pathetically grateful for tiny increases in the pittance they receive for seeing Medicare patients. Now they will toss in a few extra bucks for tricking Granny into signing her own death warrant.


Speaking of the party line, Doug Powers points out that the real villain of this piece is actually (you guessed it) George W. Bush:

An administration spokesman said the regulation, which is less specific than the reform law’s draft language, is actually a continuation of a policy enacted under former President George W. Bush.

This is getting to be as hilarious as the “unexpected” increases in unemployment reported by AP, et al. Bush, we were told, was a brain-dead moron controlled by Dick Cheney and “Big Oil.”

Somehow, though, he’s still pulling the puppet strings 2 years after he went back to Crawford. Every bad decision that the Obama adminsistration makes is somehow the fault of “Dubya.”

    We don’t seem to have a “leader” in the Republican party, so it looks like the Tea Party Patriots will have to do the job to get this guy out of the White House! After all it was the Tea Party who won the Congress for us.

    This admininsitration does NOT believe ALL of us are created EQUAL and are entitled life, liberty and the pursuit of happiness! That does NOT include DEATH PANELS (or whatever euphemism they use)! So LET THE FIGHT FOR “OUR LIVES begin —
