My latest column for the American Spectator discusses tomorrow’s Supreme Court conference about Virginia’s request for expedited review of its ObamaCare lawsuit:
When the U.S. Supreme Court is in session, each Wednesday and Friday afternoon is set aside for an esoteric conclave known as the Justices’ Conference … Friday’s conference schedule includes consideration of a “petition for certiorari before judgment” filed pursuant to Commonwealth of Virginia v. Sebelius.
Virginia’s AG wants the case decided quickly so the uncertainty created by conflicting decisions by lower courts can be cleared up:
Oddly, considering its oft-repeated assertion that Congress does indeed possess the authority to impose such a mandate, the Obama DOJ has taken the opposite view. It has, in fact, worked diligently to put off the inevitable day when it must make that case before the Supreme Court.
Tomorrow, the justices will decide whether to approve Virginia’s petition or just keep us hanging on. The rest of the column can be read at this link.
